He only look at things in one side. Yes, a reasonable person would conclude that gathering food on a public roadway not only endangers that person, but endangers the lives and property of others. But he did not consider the point that a reasonable squirrel who is merely collecting food from the roadside might want to argue that it was your negligence. Of course you can counter argue that the squirrel contributed to some negligence. by ignoring the squirrel's point of view your lawyer already violating the law of natural justice.
