A civilian got charged for drunk driving when he left his car running while sleeping inside it to sleep off to a sober stage.

However, the police and the court say that leaving the car on, even if you are sleeping, and drunk at the same time, means you were drunk driving.

Every drunk man has his rights, including the right to be considered DUI even then they are sleeping in the car and not driving it.

    I think they can do the same even if your sleeping in car and keys are in pocket or even trunk of car. They might be able to arrrest you if your walking to car with keys in hand or with you.
